Galata Tower Ownership: IMM’s Request Rejected, Foundations Retain Control

Istanbul, March 29 – The Directorate General of Foundations announced today that the Istanbul 18th Civil Court of First Instance has rejected the Istanbul Metropolitan Municipality’s (IMM) request concerning the ownership of the Galata Tower. Consequently, the iconic landmark will remain under the administration of the Directorate General of Foundations.

The announcement, made via the Directorate’s social media account, stated, “The Istanbul 18th Civil Court of First Instance rejected the Istanbul Metropolitan Municipality’s request in the lawsuit regarding the ownership of the Galata Tower. The Tower will continue to be under the administration of the Directorate General of Foundations with its endowed foundation status, in line with foundation records and current legislation. Title deeds, cadastral, and archive documents clearly demonstrate that the Galata Tower belongs to the ‘Kule-i Zemin Foundation’. With this decision, the legal process concerning our historical heritage, the Galata Tower, has been finalized.”

Historical Context and Legal Precedent

The Galata Tower, a prominent feature of Istanbul’s skyline, has been the subject of an ongoing legal dispute regarding its ownership and administration. The Directorate General of Foundations has consistently asserted its claim based on historical records, which indicate the tower’s status as a ‘Kule-i Zemin Foundation’ property. This recent court decision reinforces the Directorate’s position and brings a definitive conclusion to the legal proceedings.

The ‘Kule-i Zemin Foundation’ refers to historical endowments established to maintain and operate significant structures, including the Galata Tower. These foundations traditionally held responsibility for the preservation and management of such cultural assets, ensuring their upkeep and accessibility.

Implications for the Galata Tower’s Future

With the court’s ruling, the Directorate General of Foundations will continue to oversee the maintenance, restoration, and operational aspects of the Galata Tower. This decision is expected to ensure the continued preservation of the historical structure in accordance with its foundation status and relevant legal frameworks.

The Galata Tower, originally built in the 14th century, has served various purposes throughout its history, including a watchtower, a prison, and an observatory. Today, it stands as a major tourist attraction, offering panoramic views of Istanbul and drawing countless visitors annually. Its continued management by the Directorate General of Foundations is anticipated to uphold its cultural and historical significance for future generations.

The Istanbul Metropolitan Municipality’s request, which has now been formally rejected, sought to transfer the ownership or administrative control of the tower to the municipality. The court’s decision underscores the legal solidity of the Directorate General of Foundations’ claim, rooted in historical documentation and existing legislation.

This ruling is a significant development in the ongoing efforts to clarify the legal status of historical properties in Turkey and reaffirms the role of the Directorate General of Foundations in safeguarding the nation’s rich cultural heritage.
